Families supporting a loved one with a disability or diminished capacity are often faced with difficult decisions about balancing protection with independence. This presentation will examine the range of legal options available, from guardianship and conservatorship to less restrictive alternatives such as supported decision-making, powers of attorney, health care proxies, and advocate appointments.
* Speaker Attorney Meredith H. Greene will discuss when guardianship may be appropriate, the legal standards and court procedures involved, the responsibilities of a guardian, and the circumstances requiring additional court authorization. She will also explore the growing role of supported decision-making as a person-centered approach that promotes autonomy while providing the support individuals need to make informed decisions when possible and appropriate given the individual’s capacity to make decisions.
* Meredith is the mother to a young adult with intellectual disabilities. Her practice focuses on Special Needs Planning that includes estate planning with special needs trusts, guardianship and conservatorship, adult services, and government benefits advocacy. She is a member of the Special Needs Alliance, NAELA, and numerous other professional organizations.
